The Labor Code of the Philippines (P.D. 442), which was promulgated in 1974, serves as the country’s legal framework for labor and employment. It establishes the legal foundations for hiring practices, workplace condition standards, minimum wages, statutory employee benefits, and protection against unfair dismissal, among others. It also regulates labor relations, unions, and collective bargaining.

In this blog, we’ll provide a quick guide on how to obtain a DOLE Certificate of No Pending Case — a type of good standing certificate — and explore some of the most common labor issues and cases that may prevent employers from securing it.

Department of Labor and Employment (DOLE)

Tasked with the enforcement of the provisions of the Labor Code, the Department of Labor and Employment (DOLE) formulates policies, implements programs, and serves as the policy-coordinating arm of the executive branch in terms of labor and employment. Through the exercise of visitorial powers under Article 128 of the Labor Code, as amended, the agency is also mandated to review labor standards cases coming from regional offices and order of the Philippine Overseas Employment Administration (POEA) administrator pertaining to recruitment violations.

6 Common Labor Issues and Cases Employers Face with DOLE

Labor-related cases faced by employers in the Philippines typically arise from alleged violations of labor laws, employee rights, and contract obligations, which are often filed by their employees or investigated by DOLE itself. Here are some of the most common labor issues and cases:

1. Illegal Dismissal

One of the most frequently filed complaints with DOLE, illegal dismissal from employment happens when an employee claims that he or she was terminated without just or authorized cause or without due process as mandated by labor laws .

2. Non-Payment or Underpayment of Wages

Various issues related to employee wages, such as non-payment or underpayment of the minimum wage, overtime pay, holiday pay, and night differentials; unauthorized salary deductions; and delays in wage release, are also often reported to DOLE. These can then lead to penalties, fines, or even criminal liabilities.

3. Non-Issuance of Employment Benefits

Other than those related to wages, there are also various complaints involving non-compliance with mandatory benefits (i.e., SSS, PhilHealth, Pag-IBIG, 13th-month pay, etc.) and non-remittance of statutory deductions to the concerned agencies.

4. Unsafe Working Conditions

In terms of work safety, there are also many filed reports of unsafe or unhealthy working environments, including lack of personal protective equipment (PPE), poor sanitation, and failure to follow occupational safety and health (OSH) standards.

5. Harassment and Discrimination

Cases involving workplace harassment, abuse of authority, or discrimination based on gender, age, or religion are also handled by DOLE and other related labor bodies. If employers are found guilty of initiating or tolerating these, they can face legal consequences under labor and civil provisions.

6. Labor-Only Contracting

Labor-only contracting, or outsourcing workers without compliance with legal contracting requirements and employee benefits, is prohibited under labor laws, and if found guilty, employers may face liabilities for violations of labor standards.

What is a DOLE Certificate of No Pending Case?

A DOLE Certificate of No Pending Case is a clearance or a good standing certificate issued by the Department of Labor and Employment (DOLE) to a requesting employer to prove that it has no pending labor case filed with the department, involving violations of General Labor Standards, Occupational Safety and Health Standards (OSHS), and Child Labor Law at the time of request.

Purposes of a DOLE Certificate of No Pending Case

Employers and business organizations usually request the DOLE Certificate of No Pending Case for the following purposes:

Special Accreditations

If your business organization is seeking special accreditations, especially in sectors like construction and recruitment, you will most likely require the certificate to prove that you operate in compliance with labor laws and have no outstanding labor-related issues.

Project Bidding

Government and private sector project bids frequently require bidders to present a clean legal and labor record. The certificate helps demonstrate a company’s reliability, legal compliance, and ability to manage workers responsibly—an important factor in competitive bidding.

License Renewal

Some business licenses, particularly for agencies and contractors, require proof of compliance with labor regulations. The certificate is submitted to DOLE or other licensing bodies to support the renewal process and confirm that the company is operating lawfully.

Withdrawal of Escrow Deposit

Recruitment agencies may need to withdraw escrow deposits held by the government as part of their licensing conditions. One of the requirements is the DOLE Certificate of No Pending Case, which proves that there are no outstanding labor claims that could affect the release.

Other Legal Purposes

The certificate can also be required in various legal proceedings or government transactions where proof of clean labor standing is necessary. It may support compliance audits, mergers, due diligence checks, or internal corporate processes.

DOLE Certificate Request Requirements

To request a DOLE Certificate of No Pending Case, prepare the following requirements:

  1. Formal Request Letter
  2. Certificate of Registration of Establishment Under DOLE Rule 1020
  3. Other Additional Documents (e.g., Official Receipt of Bidding Fee, for bidding purposes)
  4. Authorization and Valid IDs (if filed through an authorized representative)

How to Request a DOLE Certificate of No Pending Case (Step-By-Step Guide)

Like other certificates of good standing (e.g., SSS, PhilHealth, and Pag-IBIG clearance certificates), the DOLE Certificate of No Pending Case can be requested with minimal documentary requirements. To do so, here is a step-by-step guide:

1. Secure All Documentary Requirements.

You need to address your formal request letter to the DOLE Regional Director and include the name of your company or business. If the request will be processed by an authorized representative or a service provider, you will need a notarized special power of attorney (SPA) and valid IDs for attachment. Once complete, proceed to scanning them for digital copies.

2. Access the DOLE Client Portal and File the Request.

Visit the official website of the DOLE Regional Office with jurisdiction over your business address and look for Certificate of No Pending Case among the available services under the DOLE e-Filing Service (Client Portal). Fill out the online request form and upload the documents.

3. Check the Status of Your Request.

You may check the status of your certificate request from time to time via the Track My Application feature and with your Transaction ID. Take note that it can take up to seven (7) working days for the DOLE Regional Office to act on your request.

4. Claim Your DOLE Certificate.

After having confirmed that your DOLE Certificate of No Pending Case has been generated, you may then proceed to the DOLE Regional Office (i.e., at DOLE-NCR Building 967, Maligaya, Malate, Manila 1004 for Metro Manila areas) to pick up the document. If filed by a representative, then a copy of the SPA and valid ID of the signatory must be presented.
